Welcome to Poppy Sky Balloon Co. (“we,” “our,” or “us”). Please read these Terms of Service (“Terms”) carefully before using our website or services. By accessing or using our site, placing an order, or engaging with us in any way, you agree to be bound by these Terms.
If you do not agree with these Terms, please do not use our website or services.
1. Services
We offer custom-designed balloon bouquets, seasonal decorations, and related products/services. Availability of certain products may be limited or seasonal. We reserve the right to update, discontinue, or modify services at any time.
2. Orders & Payments
All orders must be placed through our website or approved channels. Full payment is due at the time of booking for all bouquets and grab-and-go options unless otherwise stated.
All event installs require a 50% non-refundable deposit to hold your date. The balance is due in full 1 week prior to your event. Failure to provide the balance in full within a week of your event, we may cancel your order without a refund.
We accept payments via Stripe, Squarespace and other approved methods. You are responsible for providing accurate payment and contact information. If your payment fails or is declined, we may cancel your order.
3. Cancellations & Refunds
Because our products are custom and made-to-order, all sales are final.
Cancellations made more than 5 days before delivery/pickup may be eligible for store credit at our discretion. No refunds will be given for cancellations within 5 days of the event.
If we must cancel due to unforeseen circumstances, you will be offered a reschedule or full refund.
4. Delivery & Pickup
We offer delivery within designated service zones at an additional cost. It is your responsibility to be available during your selected delivery window. If we are unable to deliver due to incorrect information or unavailability, re-delivery fees will apply.
Pickup times are by appointment only. Orders not picked up at the scheduled time may be forfeited without refund.
If you are unavailable during your delivery or pick up window, we cannot guarantee a rescheduled delivery time of your choosing or your event time and date.
Once balloons are delivered or picked up, risk of loss, damage, or popping transfers fully to the customer.
5. Weather & Balloon Care
Balloons are sensitive to heat, wind, rain, humidity, and other weather conditions.
We are not responsible for balloons that pop, deflate, or are damaged due to weather exposure, especially high temperatures or direct sunlight. Latex balloons expand in heat and may burst. Balloons oxidize in heat. If you choose to use or display balloons outdoors, please do so at your own risk. We will not issue refunds for damage to balloons due to outdoor weather.
We recommend storing balloons in a cool, shaded, indoor area prior to use and avoiding leaving them in vehicles or other hot environments.
We will not issue refunds due to inclement weather the day of your outdoor event. In booking an outdoor installation or grab-and-go for an outdoor event, please make indoor contingency plans for your balloons.
All balloons indoor and outdoor should be handled with care. Balloons pop, so the utmost delicacy and care must be taken when handling. Balloons should be kept away from heat sources including but not limited to, open flames, radiators, heaters, heat vents, and sun through windows.
6. Safety Notice: Helium Use
Do not inhale helium. Inhaling helium can be dangerous and may result in serious injury or death. Our helium-filled products are for decorative purposes only.
Keep all balloons out of reach of young children, and dispose of deflated or popped balloons immediately to avoid choking hazards.
7. Product Use & Liability
Our products are intended for short-term use and should be handled with care. Once balloons are delivered or picked up, they are your responsibility.
We are not liable for injury, damage, or loss resulting from improper use, transportation, or storage of balloon products.
8. Intellectual Property
All designs, photographs, text, branding, and website content are the property of Poppy Sky Balloon Co. and may not be copied, reused, or reproduced without written permission.
The names “Poppy Sky Balloon Co.,” “August & Eve,” “The Party Edit,” and all product or bouquet names appearing on our website or marketing materials are trademarks or trade dress of Poppy Sky Balloon Co. You may not use, reproduce, or reference these names or any confusingly similar variations without our prior written permission.
9. Designs
All balloon designs shown on the website are examples and designs delivered are subject to change without notice based on artist style and creative liberties. Designs will remain close to the example but can never be duplicated exactly as the example shows. No refunds will be issued due to variations in the final product from the original example.
10. Contact Information and Customization
It is your responsibility to ensure that all contact information is updated with information that is checked regularly. In placing an order, you agree to respond to all communications regarding your order within 24 hours of receipt.
Failure to respond to customization questions within a reasonable time may result in alterations in the design.
You agree to be reachable on the day of pick up or delivery/installation.
11. Privacy
Your use of this website is also subject to our Privacy Policy. We take your privacy seriously and handle your information with care.
12. Limitation of Liability
We are not responsible for delays, damage, or issues caused by circumstances outside our control, including but not limited to weather, traffic, or third-party shipping errors.
In no event shall Poppy Sky Balloon Co. be liable for indirect, incidental, or consequential damages arising from the use of our services or products.
13. Changes to Terms
We reserve the right to update these Terms at any time. Changes will be posted to this page with an updated effective date. Continued use of our site or services after changes constitutes your acceptance of the revised Terms.
14. Customer Acknowledgment & Reviews
By placing an order with Poppy Sky, you acknowledge and agree to the policies outlined on this page. Many of our products are custom, delicate, and impacted by factors outside of our control (such as weather, pets, transportation, or handling after pickup/delivery). For this reason, dissatisfaction with conditions clearly addressed in these Terms & Policies does not qualify for a refund, chargeback, or claim of misrepresentation.
We welcome honest feedback and are committed to resolving concerns directly whenever possible. If you experience an issue with your order, please contact us so we can work with you toward a solution. While we encourage open communication and fair reviews, we kindly ask that customers avoid posting misleading, false, or defamatory statements, as these may result in legal action to protect our business reputation.
15. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Kentucky. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Fayette County, Kentucky.
16. Explicit No-Warranty Clause
All products are provided ‘as is’ without warranties of any kind, express or implied, including durability beyond the event date.
17. Photography / Marketing Use Clause
By engaging our services, you grant Poppy Sky permission to use photographs of your event or products for promotional purposes unless you notify us in writing prior to your event.
We will never publish personal or identifying information (such as home address or children’s names) without your consent.
18. Age Requirement / Eligibility
By using this site, you confirm that you are at least 18 years of age or have parental/guardian consent.
19. Force Majeure
We are not liable for failure to perform, or delays in performance, due to events beyond our control, including but not limited to natural disasters, accidents, power outages, strikes, government restrictions, or emergencies. If such an event occurs before we have begun production of your order, we may offer to reschedule or issue a store credit at our discretion. If your balloons have already been prepared or delivered, no refund will be issued.
20. Health & Allergy Disclaimer
Some products contain latex, which may cause allergic reactions. It is the customer’s responsibility to inform guests and take necessary precautions.
Event Installations & Rentals
21. Event Installations & Rentals
a. Rental Property
Unless otherwise stated in writing, all non-balloon items provided for your event (including but not limited to stands, frames, backdrops, hardware, weights, and other décor supports) are rentals and remain the property of Poppy Sky Balloon Co. These items must be returned in the condition in which they were provided.
b. Access & Timing
The client is responsible for ensuring our team has timely access to the event venue for setup and teardown at the agreed-upon times. Delays caused by the client, venue, or third parties that prevent timely setup or teardown may result in additional labor or return trip fees.
c. Damage, Loss, or Theft
The client assumes full financial responsibility for any damage, loss, or theft of rental property while in their care, possession, or control. Replacement or repair fees will be charged at current market value.
d. Tear-Down & Removal
Unless otherwise agreed in writing, our team will return at the scheduled time to remove rentals and décor. If access is denied, delayed, or rescheduled without prior agreement, additional fees will apply.
e. Client-Provided Surfaces
Installations may require attaching balloons or décor to walls, ceilings, or other surfaces. While we take care to minimize damage, Poppy Sky Balloon Co. is not responsible for ordinary wear, residue, or damage resulting from installation or removal.
f. Outdoor Installations
Outdoor installations are subject to weather and environmental conditions beyond our control. We do not guarantee the longevity of balloons outdoors and are not liable for damage caused by heat, wind, rain, or other elements once installation is complete.
